2. Description of Service

SnagKit provides web screenshot, screen recording, and animation generation services through:

• Web-based Studio interface
• RESTful API for programmatic access
• Cloud storage for temporary file retention

3. Account Registration

To use the Service, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized access

4. Subscription Plans and Billing

4.1 Subscription Tiers

We offer multiple subscription tiers (FREE, BASIC, PRO, ENTERPRISE) with different usage limits, features, and retention periods as described on our pricing page.

4.2 Billing

• Subscriptions are billed monthly or annually in advance
• All fees are non-refundable except as required by law
• We reserve the right to change pricing with 30 days notice
• Failed payments may result in service suspension
• Overage charges may apply for usage beyond your plan limits

4.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months.

5. Acceptable Use Policy

You agree not to use the Service to:

• Capture content you do not have permission to access
• Scrape, crawl, or harvest data without permission
• Circumvent rate limits or usage quotas
• Resell or redistribute the Service without authorization

• Capture sensitive personal information of others without consent

6. API Usage Terms

6.1 API Keys

• Keep your API keys confidential and secure
• Do not share API keys publicly or in client-side code
• Revoke compromised keys immediately
• You are responsible for all usage under your API keys

6.2 Rate Limits

API usage is subject to rate limits based on your subscription tier. Exceeding rate limits may result in request throttling or temporary service suspension.

6.3 Service Level

We strive for 99.9% uptime but do not guarantee uninterrupted service. Enterprise plans include SLA guarantees.

7. Intellectual Property

7.1 Our IP

SnagKit and all related trademarks, logos, and service marks are our property. The Service and underlying technology are protected by copyright and other intellectual property laws.

7.2 Your Content

You retain ownership of content you capture using our Service. You grant us a limited license to store and process your content solely to provide the Service. We do not claim ownership of your captures.

7.3 Captured Content Responsibility

You are solely responsible for ensuring you have the right to capture and use any content created through our Service. We are not liable for copyright infringement or other violations resulting from your use of captured content.

8. File Retention and Deletion

All captured files are automatically deleted after their retention period expires based on your subscription tier. We are not responsible for preserving your content beyond these periods. Download important files before expiration.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SNAGKIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless SnagKit from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you capture or create using the Service

12. Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Abuse of the Service

Upon termination, your right to use the Service ceases immediately and your data will be deleted according to our retention policy.

13. Governing Law
